1. Introduction

Welcome to Scooty Wala. These Terms and Conditions ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.

Scooty Wala ("we," "our," or "us") reserves the right to modify these Terms at any time. Your continued use of the Services constitutes acceptance of any changes.

2. Acceptance of Terms

By using our Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our Services on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

3. User Accounts

• Account Creation: You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials.
• Account Security: You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
• Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activities.
• Accuracy: You agree to provide accurate, current, and complete information during registration and update it as needed.

4. Orders and Payments

• Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason.
• Pricing: Prices are listed in PKR and are subject to change without notice. Taxes and delivery charges may apply.
• Payment: We accept various payment methods. By providing payment information, you represent that you are authorized to use the payment method.
• Order Confirmation: Once your order is placed, you will receive an email confirmation. This does not constitute acceptance of your order; it is a confirmation that we have received it.

5. Shipping and Delivery

• Delivery Areas: We deliver across Pakistan. Delivery times may vary by location.
• Delivery Time: Estimated delivery times are provided at checkout but are not guaranteed. We are not liable for delays beyond our control.
• Inspection: Please inspect your order upon delivery. If you notice any damage, contact us immediately.
• Risk of Loss: Title and risk of loss pass to you upon delivery.

6. Warranty and Returns

• Warranty: All Scooty Wala vehicles come with a 2-year warranty covering the battery and motor. Terms apply.
• Returns: You may return your vehicle within 7 days of delivery, subject to our Return Policy.
• Exclusions: Normal wear and tear, damage from misuse, or unauthorized modifications are not covered.

7. Intellectual Property

• Ownership: All content on our Services, including text, images, logos, and designs, is the property of Scooty Wala and protected by intellectual property laws.
• License: You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes.
• Restrictions: You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. User Content

• Responsibility: You are solely responsible for any content you submit, including reviews, comments, and feedback.
• License: By submitting content, you grant us a worldwide, royalty-free, perpetual license to use, modify, and display that content.
• Prohibited Content: You may not submit content that is defamatory, obscene, threatening, or violates any law.
• Removal: We reserve the right to remove any content we deem inappropriate.

To the fullest extent permitted by law, Scooty Wala shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our Services.

Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the product or service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Scooty Wala, its affiliates, officers, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Islamabad.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved, it shall be referred to mediation or arbitration in accordance with the laws of Pakistan.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting a notice on our website or sending you an email. Your continued use of our Services after any changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Scooty Wala regarding your use of our Services and supersede all prior agreements.
